According to Art. 3 of the Swiss Trademark Law, the trademark MIVELLA is confusable with the older trademark RIVELLA. Without having a clearer understanding of the license agreement, Rivella therefore produced the MIVELLA beverage for Migros. Due to a lack of success, Migros gave up MIVELLA in 2008 and now has RIVELLA on the shelf - the original sells better.
